FAQs about our H&S support service
Do I need a fire risk assessment?
Yes, if you operate a business premises, you legally require a fire risk assessment under the Regulatory Reform (Fire Safety) Order 2005. This applies to nearly all commercial properties, including offices, shops, factories, and rental properties.
The only exceptions are domestic premises occupied as a single private dwelling. Even if you work from home but have employees visit your premises, you need a fire risk assessment.
Your fire risk assessment needs to be conducted by a competent person and should be reviewed regularly or when significant changes occur in your workplace.
How often do I need to review my Health & Safety Policy?
Your Health & Safety policy should be reviewed at least annually, but also when:
- There are significant changes to your workplace or work practices
- New equipment or technology is introduced
- Following any workplace incidents or accidents
- When new regulations or legislation comes into effect
- If the nature of your work changes
Remember, your policy is a living document that should reflect your current operations and risks, not just a paper exercise for compliance.
What is a competent person?
A competent person is someone who has sufficient training, experience, knowledge, and other qualities that enable them to assist you properly with your Health & Safety duties. They need to understand:
- The work being undertaken
- The hazards and risks involved
- Best practice control measures
- Current relevant legislation
The level of competence required depends on the complexity of the situation and the particular help you need. While basic tasks might be managed in-house with appropriate training, more complex situations often require external expertise.
Who is the responsible person?
The ‘responsible person’ is legally accountable for fire safety in business or other non-domestic premises. This is usually:
- The employer for workplaces
- The owner/landlord for business premises
- The occupier/managing agent for shared premises
- The person in control of the premises
Their duties include:
- Carrying out fire risk assessments
- Implementing and maintaining fire safety measures
- Creating emergency plans
- Providing staff information, instruction, and training
- Reviewing and updating fire safety arrangements regularly
This role carries significant legal responsibilities and cannot be delegated, although tasks can be assigned to others.
